Parliament to Seek Legal Interpretation Over President's Refusal to Sign Bills

In a recent announcement, the Speaker of Parliament, Alban Bagbin, revealed Parliament's intention to seek legal interpretation regarding President Nana Addo Dankwa Akufo-Addo's decision to withhold assent from certain bills that were passed by the House.

President's Refusal to Sign Bills

Last year, President Akufo-Addo declined to sign into law the Criminal Offences Bill of 2022, the Witchcraft Bill, and the Armed Forces Bill of 2023, citing their financial implications as the primary reason for his refusal.

Parliament's Response

In response to this, the Speaker of Parliament has stated that they will pursue legal recourse in order to seek interpretation on this matter. He emphasized the importance of engaging with the President on this issue, despite their disagreement, and confirmed that they will be taking the matter to court.

Exclusive Jurisdiction of the Supreme Court

The Speaker of Parliament firmly asserted that the determination of the constitutionality of the bills in question falls within the exclusive jurisdiction of the Supreme Court. He emphasized that any allegations of misuse should be addressed through the appropriate legal channels, specifically through the Supreme Court, rather than through executive declaration.

Specific Concerns Highlighted by President

President Akufo-Addo specifically highlighted concerns about the financial implications of the Ghana Armed Forces Amendment Bill, particularly in relation to the replacement of the death penalty with life imprisonment.

Parliament's Reiteration

In response to the President's concerns, the Speaker of Parliament reiterated that any allegations of misuse of constitutional discretion should be adjudicated in a court of competent jurisdiction, as per Article 108 and subject to Article 296.

Importance of Upholding Constitutional Processes

This development underscores the importance of upholding constitutional processes and seeking legal clarity on matters of disagreement between different arms of government. It also highlights the commitment to ensuring that legislative decisions are made within the bounds of constitutional authority.

Implications and Observations

As this issue unfolds, it will be essential to observe how the legal interpretation sought by Parliament will contribute to resolving the impasse between the legislative and executive branches of government. The outcome of this legal recourse will undoubtedly have significant implications for the governance and legislative processes in Ghana.
